What Is DACA?

The purpose of DACA is to protect undocumented residents of the United States who entered the country as children. Instead of removing people who may have deep roots in the country, DACA allows qualifying immigrants to live and request work authorization within the U.S. DACA protections last for two years at a time and can be renewed on a continual basis.

Renewing DACA

Currently, the federal government has blocked any new applicants from applying for DACA protections. If you currently have DACA status, however, you can still renew your status with USCIS. This involves submitting a Form I-821D, referred to as a Consideration of Deferred Action for Childhood Arrivals.

As part of your DACA renewal application, you will have to submit a separate form for work authorization. This document is known as Form I-765, or the Application for Employment Authorization. You will also have to prove your economic need for employment by filing Form-765WS.

What if My DACA Renewal Is Denied?

If USCIS denies your DACA renewal, you still have legal options. You can request a review of your rejected renewal if you believe an error was made. For instance, if your renewal was denied because USCIS claims you did not pay the filing fee, you can present evidence that you did in fact pay the required fee.

When USCIS denies a renewal application, it does not mean deportation proceedings will begin right away, as ICE will not be notified unless your application was rejected due to fraud, a criminal offense, or a safety concern.
